It is a constitutional demand for judges to be objective. Ethical codes show that objectivity depends on rules enabling individuals to counter their subjectivity. Yet these codes focus on judges’ general behaviour while methodology strives for objectivity in the judges’ core task of applying the law on a specific case. Various methods are examined whether they guarantee or at least contribute to an objective interpretation of the law within the existing margin of interpretation. Conscious application of methodology is elaborated upon (...) as a demand of a democratic state under the rule of law. While the principle of judicial independence already limits control of the external result of the adjudication process, it is almost impossible to control the internal process of applying the law that takes place only inside the judge’s head. Thus, it is up to each judge to ensure objectivity by internally binding themselves to a conscious application of methods - therefore constituting an ethical demand. (shrink)

Die betriebliche Leistungsprogrammplanung legt die Fallklassen, die Patientenzahl pro Fallklasse sowie die Fachabteilungen eines Krankenhauses fest. Der vorliegende Artikel untersucht die Auswirkung unterschiedlicher Zielsysteme auf das Leistungsprogramm. Hierzu wird ein Modell der Linearen Programmierung entwickelt und für Zielfunktionen (z. B. Gewinnmaximierung, Bedarfsdeckung, Gewinnmaximierung unter Nebenbedingungen, Risikominimierung) berechnet. Es zeigt sich, dass ein gewinnmaximales Leistungsprogramm zu einer Selektion von Fallklassen führt, so dass eine umfassende Versorgung nicht mehr gewährleistet ist. Diese Zielfunktion ist folglich nur zulässig, falls ein Versorgungsverbund unter Aufrechterhaltung des (...) Sicherstellungsauftrages existiert. Ethische Erwägungen, wie z. B. die Aufrechterhaltung besonderer Abteilungen (z. B. Neonatalintensiv) unabhängig von ihrer Ertragslage, führen in der Regel zu einer wirtschaftlichen Schlechterstellung des Krankenhauses. Die Risikominimierung führt zu einer Standardtherapie, während eine Patientenorientierung im Rahmen der Individualisierten Therapie das Verlustrisiko erhöht und damit insbesondere für kleinere Krankenhäuser unannehmbar ist. The folk picture of agency suggests that human beings have basic agency over some of their omissions. For example, someone may follow through on a decision never to support a political party without doing anything in order to make themselves omit. A number of features appear to signal their agency: the omission is not just called intentional, it is also seen as an achievement and explained in terms of the reasons for the decision. Some philosophers have tried to debunk the (...) appearance and argue that agency over omissions always proceeds from agency over actions (on the model of Ulysses ordering his crew to tie him to the mast). Others have tried to uphold the appearance by understanding basic agency over omissions on the model of their theories of action (and most often on the model of causal theories). Against both groups, I argue for a vindication of the appearance in terms of a theory of sui generis basic agency over omissions. Basic intentional omissions are the behavioral outcomes of fluent control by their agents’ intentions. When an intention to omit fluently controls for the right omission, the omission is an intentional achievement performed because of the intention. The intention appropriately regulates the agent’s behavior so as to ensure the intended omission. We can therefore see basic agency over omissions as regulative and distinct from the agency exercised over actions. (shrink)

Actions receive teleological descriptions and reason explanations. In some circumstances, these descriptions and explanations might appeal not just to the agent’s own purposes and reasons, but also to the purposes and reasons of others in her social surroundings. Some actions have a social teleology. I illustrate this phenomenon and I propose a concept of vicarious action to account for it. An agent acts vicariously when she acts in response to the demand of another agent who knew that her demand was (...) likely to succeed. I argue that vicariousness grounds the social teleology of the resulting actions. (shrink)

This article discusses a peculiar Sā$$\dot {\text{n}}$$n˙khya-Yoga theory of transformation (pariṇāma) that the author of the Pātañjalayogaśāstra created by drawing upon Sarvāstivāda Buddhist theories of temporality. In developing his theory, Patañjali adaptively reused the wording in which the Sarvāstivāda theories were formulated, the specific objections against these theories, and their refutations to win the philosophical debate about temporality against Sarvāstivāda Buddhism. Patañjali’s approach towards the Sarvāstivāda Buddhist theories was possible, even though his system of Yoga is based on an ontology (...) that differs considerably from that of Sarvāstivāda Buddhism because both systems share the philosophical view that time is not a separate ontological entity in itself. Time is a concept deduced from change in the empirical world. This agreement results from the common philosophical orientation of Sarvāstivāda Buddhism and Yoga, which takes the phenomenon of experience as the basis of philosophical enquiry into the structure of the world. The intention that guided Patañjali’s adaptive reuse was twofold. On the one hand, he aimed at winning the debate with Sarvāstivāda Buddhism about how the problem of temporality can be solved. He thus integrated four mutually exclusive theories on temporality into a single theory of transformation of properties (dharma) involving a second-level and a third-level theory on the transformation of the temporal characteristic mark (lakṣaṇa) and on the transformation of states (avasthā), respectively. On the other hand, Patañjali intended to achieve philosophical clarification regarding the question of how exactly properties relate to their underlying substrate in the process of transformation of the three constituents or forces (guṇa) sattva, rajas and tamas of matter (pradhāna) that account for all phenomena of the world except pure consciousness (puruṣa). Patañjali’s theory of transformation is thus of central importance for his Sā$$\dot {\text{n}}$$n˙khya ontology, according to which the world consists of 25 categories or constituents (tattva), i.e., of primal matter (prakṛti) and its transformations and pure consciousness. Spatial, physical, and semantic magnitude dimensions can influence action decisions in human cognitive processing and interact with each other. For example, in the SNARC effect, semantic numerical magnitude facilitates left-hand or right-hand responding dependent on the small or large magnitude of number symbols. SNARC-like interactions of numerical magnitudes with the radial spatial dimension (depth) were postulated from early on. Usually, the SNARC effect in any direction is investigated using fronto-parallel computer monitors for presentation of stimuli. In such 2D setups, however, (...) the metaphorical and literal interpretation of the radial depth axis with seemingly close / far stimuli or responses are not distinct. Hence, it is difficult to draw clear conclusions with respect to the contribution of different spatial mappings to the SNARC effect. In order to disentangle the different mappings in a natural way, we studied parametrical interactions between semantic numerical magnitude, horizontal directional responses, and perceptual distance by means of stereoscopic depth in an immersive virtual reality (VR). Two VR experiments show horizontal SNARC effects across all spatial displacements in traditional latency measures and kinematic response parameters. No indications of a SNARC effect along the depth axis, as it would be predicted by a direct mapping account, were observed, but the results show a non-linear relationship between horizontal SNARC slopes and physical distance. Steepest SNARC slopes were observed for digits presented close to the hands. We conclude that spatial-numerical processing is susceptible to effector-based processes but relatively resilient to task-irrelevant variations of radial-spatial magnitudes. (shrink)

Culture has been identified as a significant determinant of ethical attitudes of business managers. This research studies the impact of culture on the ethical attitudes of business managers in India, Korea and the United States using multivariate statistical analysis. Employing Geert Hofstede's cultural typology, this study examines the relationship between his five cultural dimensions (individualism, power distance, uncertainty avoidance, masculinity, and long-term orientation) and business managers' ethical attitudes. The study uses primary data collected from 345 business manager participants of Executive (...) MBA programs in selected business schools in India, Korea and the United States using Hofstede's Value Survey Module (94) and an instrument designed by the researchers to measure respondents' ethical attitudes (attitudes toward business ethics in general and toward twelve common questionable practices in particular). Results indicate that national culture has a strong influence on business managers' ethical attitudes. In addition to national culture, respondents' general attitudes toward business ethics are related to their personal integrity; their attitudes toward questionable business practices are related to the external environment and gender, as well as to their personal integrity. A strong relationship exists between cultural dimensions of individualism and power distance and respondents' ethical attitudes toward certain questionable practices. The analysis of the relationship between cultural dimensions of masculinity, uncertainty avoidance and long-term orientation and respondents' ethical attitudes toward questionable practices produced mixed results, likely due to the lack of notable differences in cultural dimension scores among the countries surveyed. In the current era, building more innovative teams is key to organizational success, yet there is little consensus on how best to achieve this. Common wisdom suggests that positive reinforcement through shared positive rewards builds social support within teams, and in turn facilitates innovation. Research on basic group processes, cultural rituals, and the evolution of pro-group behavior has, however, revealed that sharing adverse experiences is an alternative path to promoting group bonding. Here, we examined whether sharing an adverse experience not (...) only builds social support within teams, but also in turn enhances creativity within novel teams. Drawing on behavioral observation of an experimental group interaction we find evidence that sharing an adverse (vs. non-adverse) experience leads to increased supportive interactions between team members and this in turn boosts creativity within a novel team. These effects were robust across different indicators of creativity: objective measures of creativity, third party ratings of the creativity of group products, and participants’ own perceptions of group creativity. Our findings offer a new perspective from which to understand how best to boost innovation and creative output within teams. (shrink)

Risk management is certainly one of the most important professional responsibilities of an engineer. As such, this activity needs to be combined with complex ethical reflections, and this requirement should therefore be explicitly integrated in engineering education. In this article, we analyse how this nexus between ethics and risk management is expressed in the engineering education research literature. It was done by reviewing 135 articles published between 1980 and March 1, 2016. These articles have been selected from 21 major journals (...) that specialize in engineering education, engineering ethics and ethics education. Our review suggests that risk management is mostly used as an anecdote or an example when addressing ethics issues in engineering education. Further, it is perceived as an ethical duty or requirement, achieved through rational and technical methods. However, a small number of publications do offer some critical analyses of ethics education in engineering and their implications for ethical risk and safety management. Therefore, we argue in this article that the link between risk management and ethics should be further developed in engineering education in order to promote the progressive change toward more socially and environmentally responsible engineering practices. Several research trends and issues are also identified and discussed in order to support the engineering education community in this project. (shrink)

The complexity of industrial reality, the plurality of legitimate perspectives on risks and the role of emotions in decision-making raise important ethical issues in risk management that are usually overlooked in engineering. Using a questionnaire answered by 200 engineering students from a major engineering school in Canada, the purpose of this study was to assess how their training has influenced their perceptions toward these issues. While our results challenge the stereotypical portrait of the engineer, they also suggest that the current (...) engineering education might fail to empower engineers to engage in ethical risk management. We therefore propose an active-learning method to help in this matter. Carried out through workshops with 34 students in chemical engineering, the effectiveness of this method has been evaluated using group interviews and questionnaires. Our results suggest that such an approach is effective, at least in the short run, to motivate students to engage in ethical risk management and to trigger reflectivity on what it means to be an engineer today. Background: Mental healthcare needs person-tailored interventions. Experience Sampling Method (ESM) can provide daily life monitoring of personal experiences. This study aims to operationalize and test a measure of momentary reward-related Quality of Life (rQoL). Intuitively, quality of life improves by spending more time on rewarding experiences. ESM clinical interventions can use this information to coach patients to find a realistic, optimal balance of positive experiences (maximize reward) in daily life. rQoL combines the frequency of engaging in a relevant context (a (...) ‘behavior setting’) with concurrent (positive) affect. High rQoL occurs when the most frequent behavior settings are combined with positive affect or infrequent behavior settings co-occur with low positive affect. Methods: Resampling procedures (Monte Carlo experiments) were applied to assess the reliability of rQoL using various behavior setting definitions under different sampling circumstances, for real or virtual subjects with low-, average- and high contextual variability. Furthermore, resampling was used to assess whether rQoL is a distinct concept from positive affect. Virtual ESM beep datasets were extracted from 1058 valid ESM observations for virtual and real subjects. Results: Behavior settings defined by Who-What contextual information were most informative. Simulations of at least 100 ESM observations are needed for reliable assessment. Virtual ESM beep datasets of a real subject can be defined by Who-What-Where behavior setting combinations. Large sample sizes are necessary for reliable rQoL assessments, except for subjects with low contextual variability. rQoL is distinct from positive affect. Conclusion: rQoL is a feasible concept. Monte Carlo experiments should be used to assess the reliable implementation of an ESM statistic. Future research in ESM should asses the behavior of summary statistics under different sampling situations. Attempting to find a property between being low and being recursive, Bickford and Mills produced the following definition. W is deep, if for each recursively enumerable set A, the jump of $A \bigoplus W$ is recursive in the jump of A. We prove that there are no (...) deep degrees other than the recursive one. Given a set W, we enumerate a set A and approximate its jump. The construction of A is governed by strategies, indexed by the Turning functionals Φ. Simplifying the situation, a typical strategy converts a failure to recursively compute W into a constraint on the enumeration of A, so that $(W \bigoplus A)'$ is forced to disagree with Φ(-; A'). The conversion has some ambiguity; in particular, A cannot be found uniformly from W. These outbreaks can be seen as a paradigm for ethical issues posed by epidemic emergencies, through the convergence of such themes as: isolation and quarantine, privacy and confidentiality and the interpretation of ethical norms across different ethnocultural settings. With an emphasis on the boundaries between public health investigations and research, this article reviews specific challenges, past practices and current normative documents relevant to the application of ethical standards in the course of outbreaks of filovirus hemorrhagic fevers. Aside from commonly identified issues of informed consent and institutional review processes, we argue for more clarity over the specification of which communities are expected to share benefits, and we advocate for the use of collective definitions of duty to care and standard of care. We propose new elaborations around existing normative instruments, and we suggest some pathways toward more comprehensive approaches to the ethics of research in outbreak situations. Khutoretskii's Theorem states that the Rogers semilattice of any family of c.e. sets has either at most one or infinitely many elements. A lemma in the inductive step of the proof shows that no Rogers semilattice can be partitioned into a principal ideal and a principal filter. We show that such a partitioning is possible for some family of d.c.e. sets. In fact, we construct a family of c.e. sets which, when viewed as a family of d.c.e. sets, has (up (...) to equivalence) exactly two computable Friedberg numberings ¼ and ν, and ¼ reduces to any computable numbering not equivalent to ν. The question of whether the full statement of Khutoretskii's Theorem fails for families of d.c.e. sets remains open. (shrink)

Bayesian approaches for estimating multilevel latent variable models can be beneficial in small samples. Prior distributions can be used to overcome small sample problems, for example, when priors that increase the accuracy of estimation are chosen. This article discusses two different but not mutually exclusive approaches for specifying priors. Both approaches aim at stabilizing estimators in such a way that the Mean Squared Error of the estimator of the between-group slope will be small. In the first approach, the MSE is (...) decreased by specifying a slightly informative prior for the group-level variance of the predictor variable, whereas in the second approach, the decrease is achieved directly by using a slightly informative prior for the slope. Mathematical and graphical inspections suggest that both approaches can be effective for reducing the MSE in small samples, thus rendering them attractive in these situations. Music can be interpreted by attributing syntactic relationships to sequential musical events, and, computationally, such musical interpretation represents an analogous combinatorial task to syntactic processing in language. While this perspective has been primarily addressed in the domain of harmony, we focus here on rhythm in the Western tonal idiom, and we propose for the first time a framework for modeling the moment‐by‐moment execution of processing operations involved in the interpretation of music. Our approach is based on (1) a music‐theoretically motivated (...) grammar formalizing the competence of rhythmic interpretation in terms of three basic types of dependency (preparation, syncopation, and split; Rohrmeier, 2020), and (2) psychologically plausible predictions about the complexity of structural integration and memory storage operations, necessary for parsing hierarchical dependencies, derived from the dependency locality theory (Gibson, 2000). With a behavioral experiment, we exemplify an empirical implementation of the proposed theoretical framework. One hundred listeners were asked to reproduce the location of a visual flash presented while listening to three rhythmic excerpts, each exemplifying a different interpretation under the formal grammar. The hypothesized execution of syntactic‐processing operations was found to be a significant predictor of the observed displacement between the reported and the objective location of the flashes. Overall, this study presents a theoretical approach and a first empirical proof‐of‐concept for modeling the cognitive process resulting in such interpretation as a form of syntactic parsing with algorithmic similarities to its linguistic counterpart. Results from the present small‐scale experiment should not be read as a final test of the theory, but they are consistent with the theoretical predictions after controlling for several possible confounding factors and may form the basis for further large‐scale and ecological testing. Connecting human minds to various technological devices and applications through brain-computer interfaces (BCIs) affords intriguingly novel ways for humans to engage and interact with the world. Not only do BCIs play an important role in restorative medicine, they are also increasingly used outside of medical or therapeutic contexts (e.g., gaming or mental state monitoring). A striking peculiarity of BCI technology is that the kind of actions it enables seems to differ from paradigmatic human actions, because, effects in the world are (...) brought about by devices such as robotic arms, prosthesis, or other machines, and their execution runs through a computer directed by brain signals. In contrast to usual forms of action, the sequence does not need to involve bodily or muscle movements at all. A motionless body, the epitome of inaction, might be acting. How do theories of action relate to such BCI-mediated forms of changing the world? We wish to explore this question through the lenses of three perspectives on agency: subjective experience of agency, philosophical action theory, and legal concepts of action. Our analysis pursues three aims: First, we shall discuss whether and which BCI-mediated events qualify as actions, according to the main concepts of action in philosophy and law. Secondly, en passant, we wish to highlight the ten most interesting novelties or peculiarities of BCI-mediated movements. Thirdly, we seek to explore whether these novel forms of movement may have consequences for concepts of agency. More concretely, we think that convincing assessments of BCI-movements require more fine-grained accounts of agency and a distinction between various forms of control during movements. In addition, we show that the disembodied nature of BCI-mediated events causes troubles for the standard legal account of actions as bodily movements. In an exchange with views from philosophy, we wish to propose that the law ought to reform its concept of action to include some, but not all, BCI-mediated events and sketch some of the wider implications this may have, especially for the venerable legal idea of the right to freedom of thought. In this regard, BCIs are an example of the way in which technological access to yet largely sealed-off domains of the person may necessitate adjusting normative boundaries between the personal and the social sphere. The second combines highness with a modified version of the proof strategy of Cooper et al. . The third theorem is a rather surprising result with a somewhat unusual proof strategy. Its proof is a 0‴ argument that at times moves left in the tree so that the accessible nodes are not linearly ordered at each stage. Thus the construction lacks a true path in the usual sense. Two substitute notions fill this role: The true nodes are the leftmost ones accessible infinitely often; the semitrue nodes are the leftmost ones such that there are infinitely many stages at which some extension is accessible. In this article, we draw on established views of CSR dysfunctionalities to show how and why CSR is regularly observed to be both shaped by and supportive of capitalism. We proceed to show that these dysfunctionalities are maintained by both the pro- and anticapitalist approaches to CSR, both of which imply an ill-defined separation of the economy and society as well an overly strong problem or solution focus on political and economic issues. Finally, we present a post-capitalist approach to CSR (...) that overcomes (1) the ill-defined separation of the economy and society, (2) the capitalist bias towards economic rationalities, and (3) the overidentification of society with its political system; this approach thus helps to manage the abovementioned CSR dysfunctionalities. This book offers fresh perspective on the role of phenomenology in the philosophy of physics which opens new avenues for discussion among physicists, "standard" philosophers of physics and philosophers with phenomenological leanings. Much has been written on the interrelations between philosophy and physics in the late 19th and early 20th century, and on the emergence of philosophy of science as an autonomous philosophical sub-discipline. This book is about the under-explored role of phenomenology in the development and the philosophical interpretation of (...) 20th century physics. Part 1 examines questions about the origins and value of phenomenological approaches to physics. Does the work of classical phenomenologists such as Husserl, Merleau-Ponty or Heidegger contain elements of systematic value to both the practice and our philosophical understanding of physics? How did classical phenomenology influence “standard” philosophy of science in the Anglo-American and other traditions? Part 2 probes questions on the role of phenomenology in the philosophies of physics and science: - Can phenomenology help to solve “Wigner’s puzzle”, the problem of the "unreasonable effectiveness" of mathematics in describing, explaining and predicting empirical phenomena? - Does phenomenology allow better understanding of the principle of gauge invariance at the core of the standard model of contemporary particle physics? - Does the phenomenological notion of “Lifeworld” stand in opposition to the “scientific metaphysics” movement, or is there potential for dialogue? Part 3 examines the measurement problem. Is the solution outlined by Fritz London and Edmond Bauer merely a re-statement of von Neumann’s view, or should it be regarded as a distinctively phenomenological take on the measurement problem?
